Terms of Service
Last Updated: September 14, 2026
1. Acceptance of Terms
By accessing or using the CrewProof website and software services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. The Service is operated by CrewProof ("Company", "we", "us", or "our").
2. Description of Service & Beta Usage
CrewProof provides workforce management tools for commercial cleaning businesses. You acknowledge that parts of the Service may be in "Beta" or "Early Access" mode. These features may contain bugs or errors. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
3. Accounts and Security
You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all content posted and activity that occurs under your account.
4. Payment and Cancellation
Your first 60 days on CrewProof are a free trial — no credit card required, and no charges apply during this period. We'll notify you in advance before your trial converts into a paid subscription, and founding customers keep the pricing published on our pricing page locked in when that happens.
Once your paid subscription begins:
- Subscriptions: Service is billed on a monthly basis.
- No Refunds: Due to the nature of digital SaaS products, we do not offer refunds for partial months of service.
- Cancellation: You may cancel your account at any time via the dashboard or by emailing support. Cancellation takes effect at the end of the current billing cycle.
5. Warranties and Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, the Company disclaims all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, timely, secure or error-free.
Location and timekeeping data. The Service records clock-in and clock-out events together with the location reported by the worker's mobile device at that moment. The accuracy of that location depends on the device, its operating system, the permissions the worker grants and the availability of GPS and network signal — none of which are under our control. Records produced by the Service are a management tool. They are not forensic evidence, nor a legal certification of attendance, of hours worked or of presence at a site.
No labour or payroll advice. The Service does not verify or certify compliance with any working-time, payroll, minimum wage, overtime or record-keeping obligation. You remain solely responsible for determining what your applicable law requires and for complying with it.
Third-party dependencies. The Service relies on third-party providers, including cloud hosting and storage, email delivery, push notification services, map providers, mobile operating systems and app stores. We do not warrant their availability, and we are not responsible for an email that a recipient's server rejects, delays or classifies as spam, or for a notification that a device does not deliver.
Availability and data. We do not commit to any service level or uptime target, and the Service may be unavailable during maintenance or for reasons outside our control. We keep backups as part of our normal operations, but we do not warrant that any particular data can be recovered. You are responsible for exporting and keeping your own copy of any information that matters to your business.
Beta features. Features identified as "Beta" or "Early Access" under Section 2 are provided for evaluation only, without warranty of any kind.
6. Limitation of Liability
READ THIS CAREFULLY
In no event shall CrewProof, nor its directors, employees, partners, agents, suppliers or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service; (iii) any inaccuracy, loss, corruption or unavailability of location, timekeeping, photographic or report data; or (iv) any failure of a report, notification or email to be generated or delivered.
Aggregate cap. To the fullest extent permitted by applicable law, the total aggregate liability of the Company for all claims arising out of or relating to these Terms or the Service, whether in contract, tort (including negligence) or otherwise, shall not exceed the greater of (a) the total amounts you paid to the Company for the Service in the twelve (12) months preceding the event giving rise to the claim, and (b) one hundred United States dollars (USD 100). This cap applies in the aggregate to all claims taken together and does not reset with each claim.
Time limit for claims. Any claim arising out of or relating to these Terms or the Service must be brought within twelve (12) months after the event giving rise to it, unless applicable law requires a longer period.
What is not excluded. Nothing in these Terms excludes or limits the liability of the Company for wilful misconduct, gross negligence, fraud, death or personal injury, or for any other liability that cannot be excluded or limited under applicable law. If any part of this Section is held to be unenforceable, it shall be reduced to the minimum extent necessary and the remainder shall remain in full force.
Translation: If your employee forgets to clock out, the GPS drifts, a report doesn't reach your client's inbox, or the service is down for a morning, and you have a dispute with your client as a result, we are not financially responsible for your lost contract. If we do owe you something, it is capped at what you have paid us over the last year, with a floor of USD 100. What we cannot and do not exclude is acting in bad faith or with gross negligence — no clause in this contract protects us from that. The software is a tool, not an insurance policy. This box is an explanation; the binding text is the one above it.
7. Your Indemnity
You decide which workers to enrol in the Service, what data to collect about them and how to use it. You are responsible for informing your workers, for obtaining any consent and for completing any works-council or employee-representative procedure that your law requires, and for the lawfulness of the monitoring you carry out.
You agree to defend, indemnify and hold harmless the Company and its directors, employees and suppliers against any claim, demand, penalty, fine or proceeding — together with reasonable legal costs — brought by your workers, your clients, a data protection authority or a labour authority, and arising out of (i) your use of the Service; (ii) the collection, monitoring or use of your workers' location or working-time data; or (iii) your breach of these Terms or of any applicable law.
Your obligations under this Section are not subject to the limits in Section 6, which limit the liability of the Company only.
8. Support Policy
Technical support is provided exclusively through email and in-app chat mechanisms to ensure accurate record-keeping and translation accuracy. We do not provide telephone support.
9. Governing Law
The Service is provided for business and professional use only and is not intended for consumers. By using the Service you confirm that you are acting in the course of your trade or profession.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is established, without regard to its conflict of law provisions.
Nothing in this section deprives you of the protection of any provision of the law of your own country of establishment that cannot be derogated from by agreement.
Our processing of personal data is governed by our Privacy Policy and by the data protection laws applicable in your jurisdiction — including the General Data Protection Regulation (GDPR) for customers established in the European Union — regardless of the governing law stated above.
